Who Makes The Laws?

Who makes the laws? 

"Lawmakers make the laws."

What gives them the right to make the laws? 

"Because the majority voted for them to make the laws." 

Why doesn't the majority just make the laws? 

"Because they're not smart enough to make the laws." 

Then what makes them smart enough to pick someone smart enough to make the laws?  

"Why don't you just move to Somalia?"
