Wilson & Roe (dormant company) submitted a PUBLIC response to a Judicial Council consultation on civil enforcement. Respondent: Andrew Wilson, High Court Enforcement Officer (HCEO) & Solicitor, Civil Enforcement Consultant, Wilson & Roe, High Court Enforcement, Lancashire & England & Wales. Responding on behalf of Wilson & Roe.

KEY CONTROVERSIAL POINTS:

• Writs preferred over Warrants: HCEOs paid by results and try harder than CCBs. 8% interest recoverable (Judgments Act 1838) for debts £600–£5,000. HCEO reports on unsuccessful cases comprehensive (with photo of address); CCB reports are simple pro-forma.

• CCB Call Centres replicate steps already taken by most Judgment Creditors, delaying CCB doorstep arrival. CCBs given high volumes encouraging cursory attention, travel/hour restrictions, largely ineffective by bulk users. No bonus for recovery. Bulk users rely on CCJ credit-rating impact to compel payment on new credit.

• 1991 Jurisdiction Order amendment: remove £600 HCEO limit for all CCJs (except Consumer Credit Act agreements). Simple tick-box HCEO/CCB choice replacing N293A procedure.

• Orders to Obtain Information: should return to rigorous "cross examination of the severest kind" rather than current administrative tick-box exercise supervised by court staff.

• CPR Part 71: changed from judicial cross-examination to tick-box exercise. More than one hearing standard. Only effective as lever to question a director of an established company.

• DATA ACCESS – CRITICAL GAP: TCEA 2007 Ss95–104 (Court seeking info from Government Departments, supervised by HMRC, about Judgment Debtor) NEVER brought into effect. No Regulations drafted. Courts have decided they lack the resource to implement.

• HCEOs proposed as independent well-regulated info body: most regulated group (HCEO Regs 2004), personally responsible & liable, free DVLA database access, audited without notice. Considered Officers of the Court.

• Targets Won't Pays only (have resources to settle, choose not to). 85% CCJs are Default Judgments. Access to Gov/Bank/Building Society databases for informed enforcement decisions. Excludes Can't Pay/Can't Cope. Aligns with European counterparts. Avoids blunt instrument of goods enforcement in inappropriate cases.

• ECB Standards: consulting on new standards replacing April 2014 National Standards. Most of civil enforcement industry agreed to abide.

• Debtor Engagement: 85% default. NoE 7 clear days (likely extending to 14/28). Debt Advice signposting since 2014. Suggests Driving Licence/Passport confiscation for Won't Pays. Public info programmes to persuade 10–15% to treat debt seriously.

• Enforcement Split: CCBs handle Consumer Credit Agreements, domestic Utility debt, Housing Possessions. HCEOs handle Money Judgments. Requires 1991 Order amendment. • Ineffective enforcement reflects badly on Civil Justice System, especially business debts (today's creditor = tomorrow's debtor). Can't Pays/Copes considered but those who can pay must pay – firm, fair, robust.
